AN ACT TO AMEND SECTION 83-17-113, MISSISSIPPI CODE OF 1972, TO REMOVE THE REQUIREMENT THAT CERTAIN NONRESIDENT LIFE, HEALTH AND ACCIDENT INSURANCE AGENTS MUST NOT HAVE A PLACE OF BUSINESS IN THE STATE IN ORDER FOR THE COMMISSIONER OF INSURANCE TO WAIVE THE REQUIREMENT OF A WRITTEN EXAMINATION; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 83-17-113, Mississippi Code of 1972, is amended as follows:
83-17-113. (1) A person not resident of this state may be licensed as a life, health, or accident agent upon filing the proper application and paying the required fees, provided that the state in which such person resides will accord the same privileges to a citizen of this state.
(2) The commissioner is further authorized to enter into reciprocal agreement with the appropriate official of any other state waiving the written examination of any applicant resident in such other state, provided:
(a) That a written examination is required of applicants for an agent's license in such other state;
(b) That the appropriate official of such other state certifies that the applicant holds a currently valid license as an agent in such other state and either passed such written examination or was the holder of an agent's license prior to the time such written examination was required;

(c) That in such other state, a resident of this state is privileged to procure an agent's license upon the foregoing conditions and without discrimination as to fees or otherwise in favor of the residents of such other state.
SECTION 2. This act shall take effect and be in force from and after July 1, 1999.
